On XX/XX/2021 via certified mail with return receipt, with the following tracking number ( XXXX ), I consumer XXXX sent Prosper CEO, XXXX XXXX a CEASE AND DESIST letter, along with an Affidavit of Truth. On XX/XX/2021 it was delivered, but Prosper failed to sign the return receipt acknowledging they received the communication. In the letter, it stated to cease and desist the collection of this alleged debt as well as cease contact with 3rd parties such as the Consumer Reporting Agencies. Prosper willingly continued to contact these 3rd party Consumer Reporting Agencies. Prosper also failed to rebut the affidavit. An unrebutted affidavit stands as truth in commerce. Prosper further closed the account as a charge off, which is also a violation of the cease and desist letter that they received on XX/XX/2021.
