The attached documents show WF failed to live up to the terms of the MPN for my Private Student Loans they acquired from Wachovia. 1. WF XX/XX/XXXX response to CFPB ( page 17 of doc ) explains the loans were in deferment XX/XX/XXXX- XX/XX/XXXX and as such " they did not provide statements. '' Page 14 of the attached doc ( p. 4/6 of MPN ) clearly states repayment conditions. Among these are : 1 ) I may, but am NOT required to make payments during deferment/forbearance periods, 2 ) WF was to have supplied statements during the deferment period to keep me abreast of interest accrual and outstanding balances ; 2. WF XX/XX/XXXX states XXXX and XXXX subgroups were in a disaster forbearance that was retroactively applied from XX/XX/XXXX thru XX/XX/XXXX. Therefore no derogatory history should report period ; 3. WF erroneously charged off an account that had been in forbearance and/or deferment BEFORE the due date for the statement generated XX/XX/XXXX ( see p. 23 - 24 ) Thus, WF improperly billed and reported inaccurate payment history to the CRAs and violated terms of the MPN because WF failed to deliver statements during the deferment and/or forbearance period ( s ). These types of violations are consistent with the haphazard processes that led the CFPB to issue consent order XXXX.
