In XXXX of XXXX I was sold a car and remained current on my monthly payments until XX/XX/XXXX because of being negatively affected by the pandemic. My hours at work were cut down to 0. With the passing of the Cares Act, I have become aware that the creditor must report the status of my account as current if an agreement was made after I became delinquent and that agreement was fulfilled. I have documentation of communication and agreement with the creditor. believe that the creditor wasnt aware of the Cares Act, which is a recent law that included provisions to bring fairness to people that were negatively affected by the pandemic. Timeline of Events and Agreements In XX/XX/XXXX the car broke down for the 3rd time from the time I bought it in XX/XX/XXXX. I immediately informed the creditor that I would be forced to voluntarily surrender the car. My hours at work had been cut due to covid and the car needed constant repair. Per the creditors request I had the car towed to them and was told the next step was it would be auction. I was told I would receive an Explanation of Calculation of Deficiency in the mail. I did not receive that notice until XX/XX/XXXX. The creditor and I reached an agreement that settled the account on XX/XX/XXXX. I completely fulfilled that agreement 2 months early, in XX/XX/XXXX. The only missed payments were from XXXX XXXX while waiting to receive the Explanation of Calculation of deficiency. All payments were made in regard to our agreement. The Cares Act cites that if your account is already delinquent and you bring your account to current the creditor must report that you are current on your loan.
