On or about XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX issued a TEXAS HOME EQUITY NOTE to us, which later we found out it was wrong and deceiving, we also found out that the DEED and RELEASE OF LEAN WERE EXECUTED WRONG ( INTENTIONALLY ) the note was then wrongfully assigned within 30 days to XXXX XXXX then almost immediately the note was again assigned to XXXX, which is not even a lender, the note was with XXXX for several years but XXXX collected payments from me and my wife until XXXX on behalf of XXXX XXXX XXXX, I believe they illegally collected payments from us because the note had not been assigned to them. XXXX then assigned the note to CALIBER HOME LOANS which then decided to foreclose on our property, after the foreclosure Caliber Home Loans sold or assigned the note to XXXX XXXX which resulted in a suit filed against us and a judgment was entered on or around XX/XX/XXXX after that we decided to file for Bankruptcy to protect our interest on the property and it has been depressing after that. XXXX XXXX filed a motion to issue a writ of possession on XXXX and was granted on or about XXXX my finances have been hurt so bad because of paying for my attorney and other legal fees in a effort to keep our property, so, I decided to file for Bankruptcy to protect my assets, as soon as I filed for Bankruptcy I submitted a copy of the filing to XXXX XXXX ATTORNEYS to let them know I had file for Bankruptcy, immediately as soon as they received the notice they wasted no time and sent me an email threatening to terminate the Bankruptcy Stay, I thought this was wrong so I filed for an adversary with the court and their response to this so unexpected, they are accusing me of everything they can, I believe the the Bankruptcy filing notice was very clear in addressing that they could not contact me to collect a debt that was already discharged in a previous Bankruptcy, therefore I believe I did the right thing because this action by XXXX XXXX and its attorneys/Debt Collectors had to be addressed, otherwise the will continue to do this again and again. We are scheduled for for a court hearing on XX/XX/XXXX and on this date we are probably going to be kicked out of our home, we worked so hard to pay this home and have spent around {$250000.00} in principal, interest, attorneys fees, supersedeas bonds, ETC, in an effort to keep our property I have made several offers to XXXX XXXX and its attorneys but they have rejected every offer I have made, right now there is no hope and I think we will be living on the street very soon as we have no where to go, XXXX XXXX has hurt us so much and so bad that we would like to be compensated for everything XXXXXXXX XXXX has done to us. One more thing, XXXX XXXX did not have possession of the property buy they have been selling the property on XXXX since a year ago, it has sold many times with the assumption that the property is worth {$460000.00} when is only worth around {$150000.00} due to repairs needed, XXXX XXXX has been deceiving consumers for a long time and will continue to do so if they are not stopped, I have more documents to show they XXXXXXXX XXXX has been violating consumer laws, it was not just violating my Bankruptcy stay and it is worth it to take a look at what they are doing, because they violated the Bankruptcy stay I believe I should be compensated for this too, it can not be ignored, this Bank and its attorneys/debt collectors will stop at nothing in order to achieve their goal.
