On Saturday XX/XX/XXXX, at around XXXX I went in to XXXX XXXX located at XXXX XXXX XXXX XXXX to see a car I was looking into purchasing. We ( XXXX- a XXXX employee, my brother, mother and myself ) sat inside to discuss purchase amount. I was presented the California Consumer Privacy Act form which I reviewed and signed. Form is attached. While in discussion with the sales rep, XXXX, I made him aware that I already had a preapproved loan and was not interested in financing. During discussion, he asked me questions one of which was for my social security number. Before providing it to him, I stopped him and asked Youre not running my credit, right? to which he responded No, this is being used in house. and followed with explaining it wouldnt be a hard inquiry and was just for their records. He was documenting all of these answers on his tablet. Later, I received multiple phone notifications from various credit monitoring services ; XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX- that hard inquiries were run against my credit. The inquiries displayed XXXX XXXX. When I started getting the notifications, I confronted them about why they were running my credit and where I authorized them to do that. As well as requested a copy of the form I signed that authorized to it. Another gentleman who had joined us looked confused and left to go discuss in private with XXXX. The on site manager came to our table and brought the California Consumer Privacy Act form I signed and said that this is the form that authorized the credit check. Upon reviewing again, I asked him to point out where in that document I explicitly authorized them to run my credit to which he said it doesnt say it exactly or something of that sort. I continued to push back because this form does not say anything about permission to run my credit. The manager came back and said that the form on the tablet is what authorized them to run the hard inquiry. However, I was never presented with anything on the tablet and definitely never signed, or even touched the tablet. I requested they provide me with screenshots of what was filled out on that tablet since I was never read anything, checked any boxes, signed or gave verbal authorization to do such credit inquiry. In fact, I specifically said they were not allowed to run my credit. The only form I was presented was the California Consumer Privacy act form. The manager screenshotted and printed out copies of the tablet form, including the terms and conditions which XXXX apparently signed without my knowledge. The second attachment is the screenshots the manager provided of the tablet form. Which again, I did not see, yet alone have knowledge of being filled out, checked and signed on my behalf. In summary, XXXX XXXX ran hard inquiries against my credit score after expressly being asked if they were running my credit to which they said No, and additionally, completed forms on my behalf without my knowledge that allowed them to do so.
