Consumer Narrative
On XX/XX/2021, I mailed WELLS FARGO a Cease and Desist notice pursuant to 15 U.S. Code 1692c ( c ) that they have not responded to. On XX/XX/XXXX, I mailed WELLS FARGO a Debt Validation letter pursuant to 15 U.S. Code 1692g that they have not responded to. On XX/XX/2021, I mailed WELLS FARGO a notarized Affidavit of Truth that they have not responded to. I have sent all of these letters through U.S. Postal Service Certified Mail. WELLS FARGO is being knowing and willfully noncompliant with federal law. On XX/XX/2021 at XXXX I called WELLS FARGO executive offices to respond to the " Final Response '' letter that was sent in response to the complaint I filed with the CFPB. I spoke with an agent named XXXX of WELLS FARGO executive office who stated that someone named XXXX is the person who sent the letter but the signee of the letter is named XXXX XXXX WELLS FARGO is clearly sending misleading and deceptive forms pursuant to 15 U.S. Code 1692j. The agent named XXXX stated that WELLS FARGO has been assigned to this contract, and that my contract is with XXXX XXXX XXXX. Federal law speaks about the liability of assignees. Pursuant to 15 U.S. Code 1641, WELLS FARGO is EQUALLY liable for these violations. On XX/XX/2021, I received a letter dated XX/XX/2021 that if no payment is made by XX/XX/2021, WELLS FARGO may repossess my vehicle. Because WELLS FARGO has not responded to my Debt Validation letter, they are in violation of my consumer rights for not allowing me to verify such alleged debt. A response letter titled " Final Response '' from WELLS FARGO to a previous complaint I filed to the CFPB, WELLS FARGO states that my cease and desist will remain in effect under my account until I remove. Which means they will be in violation of my Cease and Desist for communication with me through third parties, in other words any attempt to repossess my property. In addition to that, WELLS FARGO is still trying to collect this alleged debt from me by sending me the repossession letter dated XX/XX/2021 which is a form of communication trying to collect a debt. WELLS FARGO continues to violate my consumer rights and is being knowingly and willfully non compliant with federal law by continuing to communicate with me in regards to an alleged debt violating the Cease and Desist notice that has been put in place. The definition of " communication '' pursuant to 15 U.S. Code 1692a ( 2 ) means the conveying of information regarding a debt directly or indirectly to any person through any medium. WELLS FARGO has received my documents, and has chosen to be silent and continues to be non compliant with federal law. WELLS FARGO MUST comply with federal law and allow me to exercise my rights as a consumer to validate this alleged debt! WELLS FARGO can not collect ANY debt until such debt is verified by the consumer.
