On XX/XX/XXXX I submitted disputes to each consumer reporting agency ( Equifax, XXXX, and XXXX ) as well as the original creditor XXXX XXXX XXXX XXXX XXXX ), at the address provided by the consumer reporting agencies, in regards to the unverified balance and inaccurate account type that is being reported on this account. I received investigation results from each consumer reporting agency claiming that they have verified with the creditor that the balance has been verified as accurate. However, I have never received the investigation results from the creditor. I sent a direct dispute to the creditor/furnisher requesting verification of this balance. This is allegedly the remaining balance after the repossessed vehicle sold at the auction. In my dispute to XXXX XXXX XXXX XXXX, I clearly notified them that I never received the " Explanation of Surplus or Deficiency '' documents which verifies the reported balance. I disputed this information using the XXXX as well as my state laws. I also informed them that I never received any notification of exactly when the vehicle was to be sold or my rights to cure the vehicle. However, to date, I never received any response. According to Section 623 ( a ) ( 8 ) of the FCRA, I may dispute directly with the furnisher of information, and the furnisher is to complete their investigation as well as provide me with results within 30 days of receiving my dispute. Between the dates of XX/XX/XXXX and XX/XX/XXXX of XXXX, I sent yet another dispute to each consumer reporting agency, notifying them that I have disputed this information directly with the furnisher of information, but XXXX XXXX XXXX XXXX failed to complete their investigation and provide me with results within 30 days of receiving my dispute ; and I requested for this account to be removed from my reports, as written in the FCRA. However, each consumer reporting agency again made claims of verifying the accuracy with the creditor who never provided me any such verification upon my request. On XX/XX/XXXX, I again sent yet another dispute to the bureaus notifying them that the creditor still haven't provided any such verification of the reported balance. Again the investigation results claimed that it was verified as accurate by the creditor. However, in this dispute, I clearly requested for each consumer reporting agency to have the creditor provide me with actual verification of the balance and not just a claim of accuracy. This is NOT fair and accurate credit reporting if the consumer reporting agencies nor the furnisher are complying with the FCRA. It is clearly written in the Act that ANY information that is inaccurate, incomplete, or CAN NOT be verified MUST be DELETED. Credit reporting is not to be construed as verification of debt by any means. It is just the reporting of account information by a furnisher whom according to Section 623 ( a ) ( 2 ) of the FCRA has a DUTY to correct inaccurate information ; Section 623 ( a ) ( 1 ) ( B ) clearly says that if a furnisher is notified by a consumer of inaccurate information, and the information is in fact, inaccurate. The furnisher is NOT to report the information any further to ANY consumer reporting agency! Therefore, I am seriously confused as to why it takes so much for these consumer reporting agencies to comply when it's time for the to either report accurate, complete or verifiable information OR delete. As a consumer, I am entitled to FAIR and ACCURATE credit reporting. This information has DIRECT impact on my FICO scores and I feel as it is UNFAIR when I am desperately notifying these agencies of inaccurate and unverified information. They seem to rely solely on a computerized investigation system called " e-OSCAR ''. That is not what I consider as a reasonable investigation. No one actually reads the disputes from what I have researched. They simply scan it and assign it a two or three digit code. In other words, my dispute that I took my time to type up to explain the nature of my dispute was instead reduced to a code. This is considered as a fair investigation of disputed information?? The investigation results by each consumer reporting agency was NOT in compliance with the FCRA. Section 611 ( a ) ( 4 ) clearly states that consumer reporting agencies are to consider ALL relevant information submitted by me in consideration of their reinvestigation. However, this did NOT happen. Therefore, each consumer reporting agency are in violation of Section 607 ( b ) of the FCRA, which says that they are to assure XXXX possible accuracy.
