On XX/XX/XXXX I wrote Experian, XXXX & XXXX a Method Of Verification request letter, sent certified mail ( copy of letter attached ), regarding ; Account # : XXXX Open Date : XX/XX/XXXX Creditor : US BKPT CT OH XXXX My Method Of Verification request was received by you on XX/XX/XXXX XXXX ( proof of service attached ). They had 30 days to respond to the request per FCRA. As of today XX/XX/XXXX I have yet to receive a response to my requests or notices. I have fully investigated my rights in this matter. Under the doctrine of estoppel by silence, Engelhardt v Gravens ( Mo ) 281 SW 715, 719, the law presumes that no proof of the alleged account exists, nor does any such account, in fact, exist. I mailed certified mail a " Non Response/Intent To Sue '' letter to Experian, XXXX & XXXX , which was received on XX/XX/XXXX, XX/XX/XXXX & XX/XX/XXXX respectively ( proof of service attached ). Experian, XXXX & XXXX are in violation of my rights under FCRA in their duty to respond appropriately to a request for Methods Of Verification. Additionally, by not responding at all, they have tacitly agreed that proof of the account in question does not exist and therefore can not be verified. Per the FCRA, if a disputed account is not verified, it must be removed.
