1. ) XXXX - Misled by door-to-door salesman with XXXX XXXX XXXX ( XXXX ) that he was using our information to " pre-qualify '' us for a loan for windows. We told him we would most likely use our own financing. He assured us we were only " pre-qualifying. '' 2. ) When XXXX XXXX left, he stressed we would get a packet from GreenSky and to just " ignore '' it. 3. ) XXXX - Due to " numerous '' discrepancies and red flags described in an attachment. We canceled the XXXX agreement and requested XXXX email ALL signed documents. 4. ) XXXX - Discovered email w/subject line " Credit Application '' that upon opening was a GreenSky Shopping Pass in our names for {$46000.00}, with funds payable to XXXX. 5. ) XXXX - Contacted GreenSky, they " closed account '' at {$0.00} balance 6. ) XXXX - Concerned for identity theft, requested GreenSky explain HOW did they email XXXX a loan w/Shopping Pass, we did NOT authorize, for {$46000.00}. 7. ) XXXX - GreenSky would produce simplistic 1 page credit applications from XXXX with our signatures. 8. ) XXXX - Informed by GreenSky representative that the unauthorized loan agreement in a CLOSED STATUS - COULD POTENTIALLY BE REOPENED. She stated, In case we should change our mind. In spite of my explaining I did not authorize this loan. 9. ) Discovered verbiage in loan agreement on pg. 8 & 9, gave GreenSky INDEFINITE ACCESS TO CREDIT FILES and TO SHARE OUR PII. 10. ) XXXX XXXX XXXX - Filed XXXX complaints with XXXX and GreenSky trying to get loan agreement CANCELED and VOIDED OUT. 10. ) XXXX says through XXXX there is no loan agreement with them and talk to GreenSky if there is any line of credit. 11. ) GreenSky REFUSES to CANCEL OUT the unauthorized Loan agreement and GIVE US WRITTEN VERIFICATION. 12. ) GreenSky stated through XXXX that they gave us written verification the account was closed and blocked and THIS IS NOT TRUE, they have NOT. 13. ) This account remains in a CLOSED status only, giving GreenSky the continued right through the loan agreement to SHARE AND ACCESS OUR PII INDEFINITELY. 14. ) GreenSky states our signatures on the XXXX document make the agreement valid. 16. ) However, Texas Bus. and Comm. Code 12. Ch. 601. Sec. 601.153. - States that a merchant " may not negotiate, transfer, sell, or assign a note or other evidence of indebtedness to a finance company or other third party '' before the 5th bus. day. A merchant may not negotiate, transfer, sell, or assign a note or other evidence of indebtedness to a finance company or other third party before midnight of the fifth business day after the date the contract pertaining to a consumer transaction was signed or the goods or services were purchased.
