Affidavit of Truth Let this be known to all, I, am that I am, the consumer in fact, natural person, original creditor, lender, executor, administrator, holder in due course for any and all derivatives thereof for the surname/given name XXXX, XXXX, and I have been appointed and accept being the executor both public and private for all matters proceeding, and I hereby claim that I will d/b/a XXXX, XXXX and autograph as the agent XXXX attorney in fact, so be it ; Whereas, I of age, of majority, give this herein notice to all, I make solemn oath to the one and only most high of creation only, whoever that may be, and I depose the following facts, so be it, and Fact, the Fair Credit reporting Act noticed accuracy and fairness of credit reporting. Fact, the Fair Credit Reporting Act states that the banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. Fact, the Fair Credit Reporting Act Section 15 USC 1681n states any person who willfully fails to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of ( 1 ) ( A ) any actual damages sustained by the consumer as a result of the failure or damages of not less than {$100.00} and not more than {$1000.00} ; or ( B ) in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or {$1000.00}, whichever is greater ; ( 2 ) such amount of punitive damages as the court may allow ; and ( 3 ) in the case of any successful action to enforce any liability under this section, the costs of the action together with reasonable attorneys fees as determined by the court. Fact, I am sure the removal of my information from your website, company records, or any and all derivatives therefore, of, and/or with any affiliates will ensure my privacy rights wont be violated again due to my lack of consent and this herein unrebutted Affidavit of Truth being serviced to you today and therefore, standing as truth in commerce, so be it, and ; Fact, affiant is aware and has proof in the attachment labeled Exhibit A that XXXX is in violation of 15 USC 16981a ( k ) ( 1 ) ( b ) ( i ) because Congress states ( k ) Adverse Action. ( 1 ) In general.The term consumer report means any written, oral, or other communication of any information by a consumer reporting agency bearing on a consumers credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living which is used or expected to be used or collected in whole or in part for the purpose of serving as a factor in establishing the consumers eligibility for ( A ) credit or insurance to be used primarily for personal, family, or household purposes ; ( B ) employment purposes ; or ( C ) any other purpose authorized under section 1681b of this title. XXXX has reported inaccurate information on my consumers report, which is unlawful. Fact, affiant is aware and has proof in the attachment labeled Exhibit A that XXXX, XXXX and Equifax is in violation of 15 USC 16981n ( b ) because Congress states any person who obtains a consumer report from a consumer reporting agency under false pretenses or knowingly without a permissible purpose shall be liable to the consumer reporting agency for actual damages sustained by the consumer reporting agency or {$1000.00}, whichever is greater. XXXX, XXXX and Equifax knowingly added inquiries to my consumer report without my consent. By law, XXXX, XXXX and Equifax will have to remove and compensate me {$1000.00} per inquiry for the actual damages to my consumer report. Thank you, I swear to all information provided herein, I do so under the penalty of perjury that the information I affirm to be true, correct, accurate to my ability and knowledge, so be it ; I do not accept this offer to contract. I do not consent to these proceedings. I do not require subrogation of the bond to settle the charge.
