I am XXXX XXXX and I'm submitting this complaint myself and there is no third party involved. On XX/XX/XXXX, I the consumer, a natural person sent Great Lakes an affidavit of fact and they default on the rebuttal. Law states you have to rebuttal with a rebuttal or the affidavit stands as true. Affidavit uncontested unanswered [ United States v. Kis, 658 F. 2d 526,536 ( 7th Cir.1981 ) ; Cert . Denied, 50U.S.L.W. 2169 ; S. Ct. XX/XX/XXXX ] " Allegations in affidavit in support of motion must be considered as true in absence of counter-affidavit ''. [ Group v Finletter, 108 F. Supp. 327 Federal case of Group v Finletter, 108 F. Supp. 327 ] An affidavit uncontested unrebutted unanswered, Morris v. National Cash Register, 44 S.W. 2d 433 Morris v. National Cash Register, 44 S.W. 2d 433, clearly states at point # 4 that " uncontested allegations in affidavit must be accepted as true. On XX/XX/XXXX, I sent a Default and Opportunity to Cure with an invoice of consumer laws broken. They still defaulted with no verification of their claim against me. ( a sworn affidavit )
