On XX/XX/XXXX I applied for a mortgage that resulted in a credit report being pulled, and I was shocked to see a collection from Credit Collection Services in the amount {$1000.00} for a medical debt. Having had excellent health insurance in the past few years, and also not having been to the doctor in the past few years I was very upset to see this on my credit report destroying my credit score and rendering me unable to secure the housing I desperately need to secure for my family. On XX/XX/XXXX I contacted Credit Collection Services to inquire as to the nature of the debt, and they explained to me that this is for a XXXX XXXX unpaid bill from XX/XX/XXXX. Since I am in a very sensitive time crunch, I offered to resolve the debt instead of pursuing it with my insurance who should have paid it. They held steadfast in there position that they would not delete this account from my credit report, only update it as a paid collection. This is frankly unacceptable, as I later was informed by legal counsel that under the consumer protection statutes at both state and federal levels, that debt collectors must send out a first dunning notice allowing the consumer 30 days to dispute or pay the account before proceeding with additional collection efforts including credit reporting. On a follow up telephone call placed on XX/XX/XXXX, it was revealed that Credit Collection services had an incorrect address that they mailed the original dunning notice to, and in fact confirmed this when that original dunning notice was returned back to them by the Postal Service as undeliverable. The documented returned mail is coming from the debt collector directly, they admitted it. In addition, they also admitted that upon receiving the returned mail, the skip traced a new address that was also incorrect. It's clear that collection agencies are prohibited from submitting information to consumer reports if they have been notified that the information is inaccurate. They have a duty to operate fair and accurately. The first notice I ever received of this debt was on XX/XX/XXXX, where the communication came via the form of a credit report, and I respectfully request that my rights be respected and my time period of 30 days to dispute or pay this debt before any adverse remarks are placed on my credit report be respected and reinstated. I can not allow this account to remain on my credit report simply because I was not billed in a timely fashion, as this debt collector mailed a dunning noticed to an address from two years ago that was documented undeliverable, mail return.
