I AM XXXX XXXX AND I AM SUBMITTING THIS COMPLAINT MYSELF AND THERE IS NO THIRD PARTY INVOLVED. I reached out to the credit agencies on XXXX XXXX XXXX, and requested that they remove the account on my consumer report because they are violating a United States Code. Upon speaking to multiple representatives, I was told that they are unable to remove the account. The reasons I was given is their need to contact the " original creditor '' in order to validate the deb. I informed the agencies they are in violation of a United States Code and was told that I needed to contact the individual companies to request removal. The agency is in violation of the following United States Code : Title 15 USC 1681b - Permissible purpose of consumer reports According to 15 U.S. Code 1602k, the term credit card means any card, plate, coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. According to 15 U.S. Code 1602o, The term unauthorized use, as used in section 1643 of this title, means a use of a credit card by a person other than the cardholder who does not have actual, implied, or apparent authority for such use and from which the card- holder receives no benefit. According to the definition of credit card as above my social security credit card was used by Equifax Credit Agency without my authorization per the law stated in point 8. I, XXXX XXXX, the natural person and consumer, did not give Equifax Credit Agency any authorization in any form. According to 15 U.S. Code 1692g ( c ), the failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer. As such, I, XXXX XXXX, the natural person and consumer, do not admit any liability of said alleged debt. I, XXXX XXXX, the natural person and consumer, am the only person who is able to confirm or deny the liability for the debt, it should be noted that I have made Equifax has been made aware that this debt is alleged. As, it is unlawful for Equifax Credit Agency to continue to report information that they claim is due to the transactions or experiences between the consumer ( me, XXXX XXXX, the natural person and consumer ) and the person making the report ( XXXX XXXX XXXX ). They also claim that it has been verified yet they can not produce the individuals who verified the alleged debt. Equifax Credit Agency is providing information to a third party about myself, XXXX XXXX, the natural person and consumer, without my written instructions. This is identity theft punishable by law. According to the definition of credit card as outlined, my social security credit card was used by Equifax Credit Agency without my authorization per the law. According to 15 U.S. Code 1605, Equifax Credit Agency is spreading misinformation about myself, XXXX XXXX, the natural person and consumer, which is also slander and telecommunications wire fraud punishable by law. If this credit agency continues to refuse to change this, I will have no other choice but to petition the court and pursue tort litigation to seek my remedy.
