Consumer Narrative
In XX/XX/XXXX, I received a copy of my credit report from all 3-credit reporting bureau 's ; XXXX, Equifax, and XXXX. There were collection items on my credit report that were questionable. I reached out to all three bureau 's and disputed these items and asked them to validate this debt, verify this debt and provide me with supporting documentation ( wet ink signature of a contract with my name on it ) or any supporting documentation showing that this debt is mine. The reply back was simply, this debt has been verified. In XX/XX/XXXX, I re-disputed these items again, inquiring about methods used to determine that these debts actually belonged to me and to provide any supporting documentation that shows these 3-debts as valid and verified. XXXX and XXXX failed to respond to me, failed to accurately and thoroughly investigate and failed to provide me with any supporting documentation. The FCRA and the U.S. Congress states that the burden is on the credit bureau 's to provide documentation to the consumer that supports their verification and validation findings regarding a debt dispute. Reference : United States Court of Appeals, Third circuit, Jennifer CUSHMAN, Appellant v Transunion Corporation, No. 96-1553. Decided June 09, 1997. I cited this case when sending re-dispute request letters to all 3-credit reporting agencies, yet they have failed to comply. In addition, I have received a collection letter from XXXX XXXX XXXX XXXX for a debt that I don't recognize as belonging to me, as I can't recall signing anything or agreeing to anything. They have also failed to respond to my request to send me supporting documents that this debt belongs to me. This is negatively impacting my finances and is causing great harm to me. These bureau 's have failed to follow debt dispute procedures. I am the victim of identity theft and having documentation validating and verifying this debt is imperative. These items should be removed when they failed to accurately verify and validate the debt and send me evidence of their findings. Please allow me the ability to submit my certified letters that included my drivers license, a current utility bill and my social security number so they may help identify me. As well as my certified letter to the collection agency requesting verification, validation and any agreement/contract that identifies the debt as belonging to me.
