Consumer Narrative
I answered a call a few months ago from someone claiming to be representing a debt collection agency and they stated I owed over {$3000.00} to XXXX and they were collecting the debt. They asked me how I would pay. I told them I did not owe anything to XXXX and thought they had the wrong number. About a week later I received a letter from a credit collection agency saying I owed {$3300.00} to this collection agency from a XXXX debt. The letter said I had 60 days to dispute the claim or the agency had the right to continue to collect it from me. I sent a letter to them disputing the claim and I never heard back from them. Today I was trying to refinance the our house and the bank said that I have a {$3300.00} collection debt that was on my credit reports. I was shocked ... and upset. I do not owe anything to XXXX and am not in collection with any of my bills. I was never given any evidence of what this debt was and I had disputed the accusation. I called XXXX and they confirmed that I do not have any debt according to their records that they had no record that I had ever had a bad debt that went to collection. How can a collection agency place negative reports about me to a credit bureau without any proof that I owe a debt? Can they still post negative information and claim that you owe money after you submit a dispute? Can they make up any amount ... ..and just say that you owe it ... ..and if you don't pay they will try to ruin your credit and place false reports to credit agencies? What are the requirements for reporting debt on someones record? What proof is required? This seems so crazy. The bank representative helping me with my refinance also indicated that this looks strange and the agency submitting the claim is difficult to find ... after a number clicks/searching I found that it is. Cavalry Portfolio Services COLLECTION XXXX XXXX XXXX XXXX XXXX XXXX XXXX, NY XXXX I want this company to retract the report they sent to the creditors. They have no evidence that I owe anything ... as XXXX directly confirmed that I have no debt with them or record of unresolved debt. Now this false claim has impacted my credit score and my ability to do things like refinance my home or take out a loan.
