I am in receipt of an investigative report in which the consumer reporting agencies are conducting fraudulent re-investigations of items on my consumer reports. Congress defines what an investigative report truly is in 15 USC 1681a ( e ). However, the consumer reporting agencies are conducting investigations directly with the alleged creditor and not through personal interviews with my neighbors, friends or associates with whom I am acquainted with or may have knowledge of such items. I asked a rep for the process and the rep admitted that what Congress stated was not their process when a consumer request reinvestigation. The rep stated that the reinvestigation process involves going directly to the alleged creditor or another third party data furnishing company. They then report the factual information obtained from the alleged creditors or third party data furnishing company. If this is truly their process, it goes against the law and further violates me. This is truly unfair because if they are allowed to furnish this inaccurate information then they would furnish anything on my consumer report that anyone reported to them. I have already alerted the consumer reporting agencies to the fraud that is taking place and instructed them to remove the following items immediately which to date has not been done : XXXX Account # : XXXX US DEPT of ED/XXXX Account # XXXX Reasons for removal : XXXX and US DEPT of ED/XXXX are not even the alleged debt collectors registered name which makes this an inaccurate reporting being furnished on my consumer report. This alleged debt also arose from an extension of credit from my credit card. A credit card is defined in TILA under 15 USC 1602 ( l ) which is any card, plate, coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. 15 USC 1681a ( d ) ( 2 ) ( B ) states that this information should be excluded from my consumer report. This alleged debt being furnished on my consumer report contains information about a transaction or experience between the consumer ( me ) and the person ( corporation ) making the report. According to 15 USC 1681a. ( d ) ( 2 ) ( A ) ( i ) this should be excluded from my consumer report because this is a private matter and Congress states in 15 USC 1681 ( a ) ( 4 ) that the consumer has a right to privacy and that consumer reporting agencies must respect my privacy. I never gave this consumer reporting agency permissible purpose or consent in form of written instructions to furnish anything in my name. The above accounts directly impact my ability exercise my right to credit because my reputation with this consumer reporting agency is inaccurate and I know that the banking system is dependent on this reporting. I do not validate these alleged debts because they do not belong to me. I am a consumer as defined as a natural person according to 15 USC 1692a. ( 3 ). I entered into consumer credit transactions and what transpired as a result of utilizing my credit card should have remained a private matter. The SSA, Social Security Administration, is the card issuer and owner of my credit card and I am required to return it at their request because I do not own it. I am simply an administrator agent for my credit card and 18 USC 8 will provide that information to you and why I do not owe any alleged debt attached to it. Should these items not be removed immediately in a manner in which I deem timely and results in me being denied my right to credit, I will be forced to take legal actions for actual damages for willful noncompliance. You have 2 business days after receipt of this complaint to resolve this matter. Just as quickly as these items were added to my report without being properly investigated, I expect the same quickness in the removal of these items.
