Aspen XXXX, a/k/a Gregory Funding, is using deceptive and abusive practices to confiscate funds that are not in keeping with the strict adherence of the Deed of Trust. I have entered into an agreement with the county to compensate me for the easement for a partial taking. Gregory Funding is stating that their secure instrument requires that they are entitled to the funds, when it is clear that their formula and their interpretation of the loan document states if the partial taking is equal or more than their secured instrument. They are holding up on the Consent of the Lender letter required by the county in order to allow payment to me the borrower. The payment is in the amount of {$66000.00}. The Lender wants it applied to the mortgage, even though they are completely secured and the value of the property is approximately {$100000.00} more then the principal. They are not applying the Deed of Trust instructions in securing an appraisal immediately before the partial taking and the payoff immediately prior to the taking. The Lender will not be reasonable even when it was offered to divide the compensation due to the owner equally with the Lender.
