I called Credit Acceptance Co asking for Calculation of Deficiency or Surplus, which I never received in the mail. Under UCC Article 9-616, a creditor who fails to provide the letter waives their rights to a deficiency. Also looking over the documents gathered from the previous report my name was entered electronically without knowing. Also how can my trade name be used when my legal name status is XXXX XXXX XXXX. The installment that is listed on my credit report is nothing more than a credit sale which means it is usually sold at auction since it was voluntarily repossessed is usually sold at auction to pay off the unpaid balance. Credit acceptance has been reporting inaccurate information and would like it to be removed from my credit report.
