The sales agreement, written up and signed by both parties on XX/XX/XXXX of XXXX states two decks, an AC unit, skirting, set-up, peirs, driveway, sidewalk, hook-ups, and retaining wall are the seller 's responsibilities. We only received one deck ( that came with the house, my husband ended up building the second one himself about 1.5 years after we had moved in ), the set-up was never completed, and a retention wall was never installed. In discussing the retention wall with the property manager at the time, she also assured us that a safety fence would be installed around the edge of the yard to reduce any fall risks for children. I received a pre-approval notice from the account manager at the bank that the property manager worked with on XX/XX/XXXX in the amount of {$55000.00}. With no notice from the property manager, twelve days later I received a second pre-approval notice for {$58000.00}. When I received the second pre-approval notice, I contacted the property manager to ask why the amount was higher, she verbally told me that the difference in the amounts was because we needed to assist in paying for the retention wall. My husband and I discussed if the increase in price was worth moving forward and went back and forth with the property manager for approximately two weeks after the second pre-approval notice. While on the phone with the property manager, she said, " Your setting costs increased because of the retention wall, so if you don't pay for it, we'll just find someone else who will. '' We decided to move forward because we needed somewhere to live, expecting the property manager to handle things properly. We were told the retention wall and fence would be installed before our house was due to be delivered mid-May. A few weeks later, we received notice that there was a delay in the completion of our house due to the weather and it wouldn't be there until the beginning of XXXX, then another delay for the end of XXXX. Then it was delayed again for XXXX, end of XXXX, XXXX, and was finally delivered XX/XX/XXXX. The retention wall and fence still hadn't been installed even with the XXXX delivery delay. It's now XX/XX/XXXX and the retention wall and fence have still not been put in place. We verbally discussed this with the property manager any chance we saw her around the park during the 2.5 years she resided in the park, and also met with her at the office to discuss it at least 3 times. We were always reassured it was " getting figured out ''. Finally, in early spring of XXXX, the property manager told us that " the owners aren't going to put a wall in ''. Shortly after she told us there wouldn't be a retention wall installed, that specific property manager was fired and there is a current investigation regarding her actions as the property manager of the park. Due to the lack of a retention wall, the ground underneath our house has consistently been receding since our arrival. About a year after we moved in, our house was no longer even touching the cinderblocks they placed under the house to support it. There is significant damage to our house and property because of it settling incorrectly. Additionally, the park continues to send us notices of violation for our skirting not being fixed properly which we are unable to do as the ground has receded and the skirting isn't long enough to fit correctly.
