Debt Collection Agency : National Credit Systems XXXX XXXX XXXX XXXX XXXX. XXXX, GA XXXX ( XXXX ) XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX/XXXX XXXX Tx Creditors additional Debt Collector XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, GA XXXX XXXX XXXX XXXX XXXX. XXXX XXXX XXXX, GA XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX TX XXXX Inaccurate Amount Reported Claiming I Owe {$31000.00} I have written numerous letters requesting the mentioned debt removed and deleted from all reporting agencies, however, National Credit Systems XXXX, the XXXX XXXX XXXX XXXX XXXX XXXX and XXXX XXXX XXXX XXXX Tx continue to refuse to remove it. I have previously attempted to obtain information, validate and dispute the mentioned alleged debt on several occasions, however, National Credit Systems disregarded many of my requests by sending only partial information. I did not receive the extended email chain referencing the many complaints which were never resolved including but not limited to excessive noise and other significant documentation. National Credit Systems is reporting to the credit bureaus, however, they still have not validated the alleged debt in direct violation of VALIDATION made pursuant to 15 USC 1 692g Sec. 809 ( b ) of the FDCPA ( see Exhibit A ). The email communication with XXXX XXXX ( Landlord ) clearly illustrates the repeated refusal to abide by the Texas Property Code by placing barriers, conditions and restrictions on the me which is breaking the law. XXXX XXXX, The Property Owners and their affiliates are in direct violation of Section 92.016 of the Texas Property Code for its repeated refusal to allow the tenant ( me ) to break the lease by placing barriers, conditions, and restrictions on me and my occupant minor child ( the victim ) are breaking the law and are subject to a civil penalty of one months rent plus {$500.00}, damages, and they must pay the victims attorneys fees. Additionally, I was fraudulently induced into signing the lease by Landlords agent representing the property is a quiet and safe environment for my child to live in. On countless occasions my child was exposed to foul language, smell of XXXX, loud neighbors, cut his foot on broken beer bottle glass at the pool after a management sponsored a large party and my car was broken into. The documented and reported crime at the property became an unsafe place for my child and I to live. Much of this is referenced in the email communication sent to National Credit Systems and XXXX XXXX. If needed, many of the Parties involved including but not limited to an onsite XXXX Police Officer, Security Guards, Concierges, Tenants, Maintenance, Employees, Management, Owners and their affiliates would confirm all of this information. On XX/XX/XXXX, a XXXX County Judge issued an order containing an injunction to protect my child. Section XXXX of the Texas Property Code gives victims of XXXX XXXX the right to vacate the dwelling and avoid liability for future rent and any other sums due under the lease for terminating the lease and vacating the dwelling before the end of the lease term without notice. Landlords who do not allow the tenant to break the lease or who attempt to place barriers, conditions, or restrictions on the victim are breaking the law and are subject to a civil penalty of one months rent plus {$500.00}, damages, and they must pay the victims attorneys fees. The Landlord was well aware of the situation and the email communication with Landlord clearly illustrates the repeated refusal to abide by the Texas Property Code by placing barriers, conditions, and restrictions on the me which is breaking the law. A tenant who terminates a lease under Subsection XXXX is released from all liability for any delinquent, unpaid rent owed to the landlord by the tenant on the effective date of the lease termination if the lease does not contain language substantially equivalent to the following : " Tenants may have special statutory rights to terminate the lease early in certain situations involving family XXXX or a military XXXX or XXXX. '' For further clarification, the following paragraph was cut and pasted from the Texas Attorney Generals website : If you or an occupant of the property are the victim of family XXXX ( meaning, for example, harmful acts including XXXX, XXXX XXXX, and XXXX by a member of the family or household against someone else in the family or household ), you may terminate your lease. and leave the property without further obligation for future rent or termination fees. To exercise this right, you must have a protective order or temporary injunction, signed by a judge, against the occupant or co-tenant of your residence. Once you have delivered a copy of the protective order or temporary injunction to your landlord and you have vacated the unit, you have, by law, terminated your lease and avoided liability for future rent and other sums due under the lease for termination of the lease. If your lease does not contain language informing you of your rights to terminate the lease in situations involving family XXXX or military XXXX, you will be released from liability for past unpaid rent. If the lease does contain such language, you will still be responsible for rent owed to the landlord before you terminated the lease. If a landlord does not let you terminate the lease under these conditions, she or he may be liable to you for one months rent, plus {$500.00} and attorneys fees. Right To Quiet Enjoyment While living at XXXX XXXX, I had made over twenty complaints regarding the tenant living above me making excessively loud stomping and banging noises throughout the day and knight. Many of the complaints were documented via email with the Landlord resulting in no resolution. Many staff members visited my unit and were speechless of how loud the noise was as it literally shook my entire unit. According to the Texas attorney General, tenants have the right to quiet enjoyment. After many months of verbal and written communication to staff and management, Landlord failed to resolve the matter. I have sent letters which included the following language : I am hereby exercising my rights under the state and Fair Debt Credit Reporting Act. I hereby request that you immediately remove the mentioned account from my credit report, any previous inquiries, statements, updates etc. from all credit reporting bureaus including any other agencies including but not limited rental reporting agencies immediately. However, the XXXX XXXX XXXX XXXX XXXX XXXX and XXXX XXXX XXXX XXXX Tx continue to refuse to remove it.
