The mortgage lender working with the buyers of my home are Van Dyk Mortgage. The mortgage loan originator is XXXX XXXX of XXXX XXXX Michigan and the Regional Manager is XXXX XXXX. XX/XX/XXXX was the offer acceptance date. A delay in the process has been made 3 times to close on the property by this lender. XX/XX/XXXX I was contacted through my realtor that this lender was requesting another week to close when our date was tentative for XX/XX/XXXX.That was the first attempt at a delay. The second was a cancellation of closing suggesting their clients couldn't afford the payments on my house that they were buying. Since the lender was made aware via an email I sent to XXXX XXXX that same day of a time sensitive and personal information regarding the fact that I was in process of purchasing a condo, it is my belief they shared this information to the benefit of their buyer in an effort to get more money from me since they knew it was time sensitive. They were able to force me to give more funds from me to their client via the selling price in order to make the sale go through so that we could move forward with a close. Our scheduled close date was again pushed to XX/XX/XXXX at XXXX. Today is XX/XX/XXXX. I received a call from my realtor stating that the lender who had cleared the buyers to close, was not able to verify their employment. In other words, they gave them a clear to close without actually verifying a source of income. This is an FHA loan. They require income to be verified usually in the first step of the process to get an approval and normally in the couple of days before closing, but not when closing is less than 1 day away and is scheduled. It is my belief that this institution in addition to their avoidance and unprofessional response when they do, is out of compliance and not following mortgage laws. I am writing you to investigate this institution, it's practices, and their underwriting procedures as this is not something that should have happened 3 times or happened the way it did. Thank you in advance for your assistance in this urgent matter. Please see below message sent to the lender, XXXX XXXX on XX/XX/XXXX. XXXX, Please be advised that this closing has been in progress for several weeks. I was informed today that you, the lender are requesting a week extension to close without cause. Forgive me, but this is completely unacceptable in every way. I have been assured this entire time even after a surprise with a disappointing appraisal that I don't agree with, I pressed forward with the date of XX/XX/XXXX. I have done everything I've been asked to in a more than timely fashion to keep the ball in the air. Imagine my shock when I'm being asked for something else. At this moment in time, I have requested and am approved for time off work at a job that I'm brand new at. I have secured the only person qualify to care for my special needs son during this move who happens to live out of state. My husband will make a 12 hour drive one way just for that reason, of which he will leave his car behind with the babysitter. Subsequent to that, there is a flight booked for my husband to return here in Michigan to help move and drive the truck we reserved, another large expense. His flight also can not be canceled. With this XXXX mile move, a hotel is also necessary and that's been booked. All of these things are being 100 % paid for by myself and not from the proceeds of this home we are closing on. As you can probably tell, I am more than frustrated. I have been on track and I just don't understand how you can't get this scheduled on time. An FHA can be closed in as little as 30 days. This loan should be no different. There are no delays here and doubt there have been any on the borrower 's part. I'm asking you not to propose another date and I expect to close on time so as not to delay or worse there is a potential of losing the condo I am in the final stages of closing. As a matter of fact, we are on track to close on both homes in the same day. An extension of the date has too many losses on everyone 's part.
