I got this company named XXXX XXXX XXXX called to my son from the phone number XXXX and told him that they have a legal case against him. He got nervous and tried to get some information then they noticed that they called the wrong person. They provided with the case number XXXX to him to ask me to call them back. I called and they said that they have a summons to serve me because I'm being sued. I asked who is filing that and she said that I have fraudulent opened and some other retoric with legal terms words to tell me that I commit a federal fraud. Of course I got scared, then asked for details and she said that was a bank account in Wells Fargo opened from XXXX to XXXX. I claimed that I ad contact the bank because 2 years ago I got same call and at the bank they have nothing. My last account was closed with XXXX balance. And the collector is asking for {$1200.00} including fees and interest. Checking my rights I found that I don't have to pay fees or interest not previuosly signed and accorded. Also this account is way out of the statute of limitations, we're talking about 9 years at least. When I told them about my rigths she said that this kind of lawsuit will not be protected for the Statutes of Limitations because is considered like a federal student loan and protected by federal agencies. I didn't found anything saying that. I don't know if that is true but to me they fail since they contact the wrong person telling him that they will act legally against him.
