CREDIT SYSTEMS did not get my written permission to furnish the unauthorized debt account in the letter attached to this complaint. Pursuant to 15 USC 1681b2 ... a consumer reporting agency can only report in accordance with the written instructions of the consumer to whom it relates. I consider this to be identity theft and CFPB states that identity theft is when someone uses your name, number, date of birth, or other identifying information without your permission. I did not give any consumer reporting agency Authority to report this debt. CREDIT SYSTEMS continuously fail to do due process designed to validate the debt Furthermore, as proof of the violations of my rights, The Privcy Act prohibits the disclosure of a record about an individual from a system of records absent the written consent of the individual, unless the disclosure is pursuant to one of twelve statutory exceptions. These are the 12 exceptions : Need to Know within Agency, Required FOIA Disclosure, Routine Uses, - Bureau of the Census, Statistical Research, National Archives, Law Enforcement Request, Health or Safety of an Individual, Congress, Government Accountability Office, Court Order, Debt Collection Act. None of these would apply to me because none of the lawfully procedures were taken to validate the alleged debt. I ( the consumer ) have never validated the item listed in my attachment. The Debt Collection Act states No agency shall disclose any record which is contained in a system of recordsexcept pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains, unless the disclosure would be to a consumer reporting agency in accordance with section 3711 ( e ) of Title 31. 5 U.S.C. 552a ( b ) ( 12 ). It also goes on to say It authorizes agencies to disclose bad-debt information to credit bureaus. 31 U.S.C. 3711 ( e ) ( 9 ) ( F ). Before doing so, however, agencies must complete a series of due process steps designed to validate the debt and to offer the individual an opportunity to repay it. None of the lawfully procedures were taken to validate this alleged debt.
