How do I report companies for false and deceptive information? Companies can not simply misconstrue the law and tell consumers they are operating under the law when they give out false information and it affects people 's lives! I put in a CFPB complaint about my consumer report where a company did not follow 15 USC 1666b ( a ). I was then told as a response by XX/XX/XXXX the following message ; " Additionally, when a consumer enters into a financial obligation the consumer is agreeing that the creditor has the right to report this type of information to the credit reporting agencies. '' NO, A CONSUMER IS NOT AUTOMATICALLY AGREEING TO CREDITOR HAS THE RIGHT TO REPORT AUTOMATICALLY! THE CREDITOR NEEDS WRITTEN CONSENT BY THE CONSUMER FIRST! EXPERIAN 'S STATEMENT IS FALSE AND MISLEADING! Why? because it states it law the exact opposite must occur! And I quote 15 USC 6802 ( b ) ( 1 ) ( A ) ; " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party. '' Meaning I have to give written permission to agree for that creditor to report my information! Why wouldXX/XX/XXXX give me a deceptive answer like this? Who wrote this response? They should be held accountable as this is a violation of 15 USC 1611 ( 1 ) for giving " ... .false or inaccurate information or fails to provide information which he is required to disclose under the provisions of this subchapter or any regulation issued thereunder.
