In the initial communication with Capital One they did not state it is was an attempt to collect a debt. Capital One Bank continues to send monthly statements that does not state it's an attempt to collect a debt. Pursuant 15 usc 1692e ( 11 ) a debt collector must state it's an attempt to collect a debt under the fair debt collection practices act and Capitol one does not state that. Capital One Bank has been very false and deceptive. This is in fact a violation of 15 usc 1692e ( 11 ). I can not pay on a positive balance. That's a violation and highly false and misleading.
