As a consumer, I have rights under the Fair Credit Reporting Act. TransUnion and XXXX are both in violation of the FCRA Section 604. Permissible purposes of consumer reports and Section 607. Compliance Procedures. THEY VIOLATED THE UNITED STATES CODE LAW. My personal information was exposed in the XXXX breach in XXXX and I sent two dispute letters to Transunion and XXXX about some impermissible inquires on my consumer credit report. The first letter was sent on XX/XX/XXXX and the second letter was sent on XX/XX/XXXX. Transunion nor XXXX has yet to remove these impermissible inquires from my consumer credit report. FCRA Section 607 states that CRAs are required to make sure that consumer reports are only being used by appropriate people and for legitimate purposes, as spelled out in Section 604. FCRA Section 604. Permissible purposes of consumer reports clearly state any consumer reporting agency may furnish a consumer report under the following circumstances and no other : 1. In response to the order of a court having jurisdiction to issue, such as a subpoena, and in connection with proceedings before a Federal grand jury 2. In accordance with the written instructions of the consumer to whom it relates 3. To a person which it has reason to believe A. intends to use the information in connection with a credit transaction involving the consumer on whom the information is to be furnished and involving the extension of credit to, or review or collection of an account of, the consumer B. intends to use the information for employment purposes C. intends to use the information in connection with the underwriting of insurance involving the consumer D. intends to use the information in connection with a determination of the consumers eligibility for a license or other benefit granted by a governmental instrumentality required by law to consider an applicants financial responsibility or status E. intends to use the information, as a potential investor or servicer, or current insurer, in connection with a valuation of, or an assessment of the credit or prepayment risks associated with, an existing credit obligation F. otherwise has a legitimate business need for the information i. in connection with a business transaction that is initiated by the consumer ii. to review an account to determine whether the consumer continues to meet the terms of the account. IMPERMISSIBLE CREDIT REPORT ACCESS IS A BREACH OF PRIVACY Under 15 U.S Code 1681b permissible purposes of consumer reports I never gave Transunion and Equifax any written consent to report anything on my consumer report, nor did I instruct or give consent to anyone in writing to obtain my consumer report. No consent is Identity Theft. As a consumer, these inquires in this complaint must be deleted immediately, or I will seek monetary damages in small claims court in my city and state. Also, I have already involved and sent a letter to the attorney general 's office, XXXX XXXX XXXX and federal trade commission.
