I had a buyer for my motor-coach and I requested a 10 day payoff. As ofXX/XX/2021 the amount was {$150000.00}. OnXX/XX/2021 the motor-coach was sold and the payoff was completed. Since there was a loan payment done right before the sale, an overage was created in the amount of {$2400.00}. I called Bank of the West numerous, numerous times to find out when the overage would be refunded to me. Bank of the West assured me that within the week a check would be coming to me. I never received that check. I sent a certified demand letter on XXXX with no results. Numerous more calls were made. I called and spoke with a representative who said the check must be lost and will issue a new check and send it out.I A few days later I received a check and deposited it, only to discover that Bank of the West had a stop payment on that check.I recruited help from my bank, XXXX XXXX - XXXX, Texas branch to resolve the matter to no avail. My bank Rep. XXXX XXXX called Bank of the West and spoke with an agent that assured us that a check would go out the next morning. Needless to say, I have never received a check. This entire process started XX/XX/2021 and it is now XX/XX/2021. If needed, we have letters of documentation supporting all of the above facts. Bank of the West has never disputed that the overage is owed and the amount owed is {$2400.00}.
