Consumer Narrative
On Friday, XXXX, I received a call from my mortgage officer ( my wife and I are purchasing a home in XXXX ) informing me of a raised flag when pulling my credit score. Two of the three credit reporting agencies were within the range he and I projected I would be ( XXXX : XXXX ; XXXX : XXXX XXXX, but the third, XXXX was significantly lower ( XXXX ) due to a private student loan account reporting 90+ days past due. Immediately upon learning this, I ask that he provide any information he had regarding as I was completely oblivious and unaware. After receiving the information, I contacted the Texas Higher Education Coordinating Board to inquire further why I was not made aware of the past due balance and pay the entire balance in full. The Texas Higher Education Coordinating Board informed me that though they did have my current address on file, all correspondence previously mailed to my address was returned to them from the post office ( it is important to note, I receive mail every day to this address without issue ). Additionally, they confirmed they did not attempt to notify me beyond the mailers, which were ultimately returned to them. Knowing this, I agreed to pay the balance in full and submitted the payment the same day ( XXXX - the same day my mortgage officer first made me aware ). I also requested the Texas Higher Education Coordinating Board remove all 'Past Due ' reports submitted to XXXX as their records reflected and confirmed I was not ever adequately notified. The Texas Higher Education Coordinating Board denied my request and refused to provide any justification or supporting evidence for their denial. Before ending the call, I voiced my concern about the unfair treatment I felt I received and that I would be forced to exercise my rights as a consumer submitting a claim to the Consumer Financial Protection Bureau ( CFPB ) ; their response : " go ahead.
