I filed a dispute with XXXX XXXX Bank ( USA XXXX Na over 30 days ago and they have yet to respond to my Affidavit Of Truth, which was sent to them via certified mail. Which they received on XX/XX/21 and they have failed to answer. I informed XXXX XXXX Bank ( USA ) Na that I am disputing their claim. Moreover I requested that XXXX XXXX XXXX ( USA ) Na supply me with copy of the contract with my authentic signature and their authentic signature which makes the contract legal. XXXX XXXXXXXX Bank ( USA XXXX Na never provided a copy of contract with my authentic signature or their authentic signature and continue to report this account to the credit reporting agency. This account should have been deleted off the CRA files. Further more the fair credit reporting act regulates how creditors handle consumers dispute. The statue states that when a consumer disputes any item the creditor should conduct a reasonable investigation within 30 days to determine if the challenge item is correct. After 30 days have expired if creditor have not completed the investigation the disputed item must be deleted. Finally XXXX XXXX Bank ( USA ) Na failed to report the dispute to the CRA which is a violation of the FCRA section 623 and carries a fine. XXXX XXXX Bank ( USA ) NA has failed to show burden of proof 15 U.S. Code 1643 ( b ) Burden of proof In any action by a card issuer to enforce liability for the use of a credit card, the burden of proof is upon the card issuer to show that the use was authorized or, if the use was unauthorized, then the burden of proof is upon the card issuer to show that the conditions of liability for the unauthorized use of a credit card, as set forth in subsection ( a ), have been met. XXXX XXXX Bank ( USA ) NA has failed to reply to the affidavit, its has been well over 30 days. I am asking that all negative remarks be removed from my credit file which XXXX XXXX Bank ( USA ) NA falsely created.
