Complaint Regarding Prepayment Penalty and Hard-Money Loan PHH Mortgage Loan # XXXX Dear CFPB, I am writing to formally submit a complaint regarding a mortgage loan serviced by PHH Mortgage on the residential property located at XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXXXXXX XXXX Background : My former spouse, XXXX XXXX XXXX, passed away on XX/XX/year>. Shortly before his death ( approximately 2 months prior ), he took out a hard-money loan on this property. I was not on title at the time and did not sign the loan, nor was I informed of it before his death. After his passing, I became the successor in interest, and my son is the beneficiary of the estate. Issues : Misclassification of Loan : The lender labeled this as a commercial loan. In reality, the property is a residential home, and the funds were not used for business purposes. This misclassification appears to be a tactic to enforce extremely high prepayment penalties and avoid residential borrower protections. Excessive Prepayment Penalty : The loan includes a prepayment penalty that is extremely high relative to the principal. I am seeking to refinance to lower the interest rate and stabilize the property, but this penalty makes it financially prohibitive. The penalty appears unreasonable and possibly unenforceable under California Civil Code 1671 and applicable federal protections. Failure to Communicate : Since notifying PHH of my successor status, I have made repeated attempts to obtain account information and discuss resolution for over several months via phone and email, with no substantive response. This has created significant financial and emotional hardship, and late fees continue to accrue due to their lack of communication. Request : I respectfully request that the CFPB : Investigate the enforceability of the prepayment penalty given the loan misclassification and residential status. Require PHH Mortgage to waive or reduce the excessive prepayment penalty to allow refinancing. Review PHHs failure to respond promptly to my communications as a successor in interest. Assist in resolving this dispute so that I can stabilize the property and protect my familys interest. I have attached supporting documentation, including : Proof of death Proof of successor in interest Loan statements and communications with PHH Thank you for your attention to this urgent matter. I am seeking a fair resolution and assistance in ensuring PHH Mortgage adheres to federal and California protections for successors in interest and residential borrowers. Sincerely, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX
