Consumer Narrative
To Whom It May Concern, I am filing this complaint regarding the following collection account : JEFFERSON CAP I dispute this account in its entirety. Pursuant to the Fair Debt Collection Practices Act ( FDCPA ) 809 ( b ), I requested proper validation of this alleged debt. The collector has failed to provide sufficient documentation as required by federal law. To properly validate this account, the collector must provide : A complete accounting of the alleged debt, including principal, interest, and fees. A copy of the original signed contract or agreement bearing my signature. Documentation showing legal standing and authority to collect this debt. A complete chain of assignment from the original creditor to the current collector. Proof that the amount reported to consumer reporting agencies is accurate. Proof that the collector is currently licensed and legally authorized to collect debt in my state, including their state license number and issuing authority. If the collector is not properly licensed in my state, they do not have legal authority to collect or report this debt. Under FCRA 1681e ( b ) and 1681i, furnishers and consumer reporting agencies must follow reasonable procedures to assure maximum possible accuracy. Reporting a collection account without competent validation and proof of authority constitutes inaccurate and unverifiable reporting. Simply responding account verified through an automated system does not constitute proper validation under federal law. If the collector can not provide the documentation requested above, they must : Immediately cease all collection activity Immediately delete this account from all consumer reporting agencies Provide written confirmation of deletion Continued reporting without proper validation and proof of licensing constitutes furnishing inaccurate information and unlawful collection activity. I am requesting that the CFPB require deletion of this account if the collector can not fully comply with the above validation requirements. Sincerely, If this matter is not resolved through immediate deletion, I will pursue additional complaints with my State Attorney General and explore all remedies available under the FDCPA and FCRA for unlawful collection and reporting practices.
