Consumer Narrative

I am submitting this as a new complaint and formal reinvestigation demand, as the previous case ( # XXXX ) was closed without resolution of the underlying issue. The inaccurate reporting remains on my credit file, and I do not accept the prior closure as a final determination. This letter serves as formal notice that the accounts reported by : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX are fraudulent and do not belong to me. I did not open, authorize, apply for, or agree to these accounts. These accounts are the result of identity theft. Experian Fraud Determination I was formally informed by Experian that the XXXX and XXXX accounts were determined to be fraudulent. Experian recognized that the tradelines were the result of identity theft. Despite this, the accounts continue to be reported or handled improperly by other reporting agencies. The fact that XXXX major consumer reporting agency has already recognized these accounts as fraud demonstrates that the underlying data is unreliable and that continued reporting by others is unreasonable. FTC Identity Theft Report Filed I have filed an official Identity Theft Report with the Federal Trade Commission ( FTC ) documenting that these accounts were opened fraudulently using my personal identifying information. The FTC report was completed truthfully and under penalty of perjury. This is not a casual dispute. This is not a billing disagreement. This is a documented identity theft claim. Closure of Prior Case Was Procedural, Not Substantive The previous case ( # XXXX ) was closed, but the inaccurate reporting remains. Closing a complaint without correcting the underlying inaccuracy does not resolve the issue. The accounts still appear as derogatory collections and continue to : Lower my credit score Misrepresent my creditworthiness Influence lending decisions Cause ongoing financial harm Because the reporting persists, this matter remains unresolved. Demand for Method of Verification If the accounts are being maintained as valid, I am demanding full disclosure of the method of verification used, including : The specific documents reviewed Whether verification was conducted electronically through e-OSCAR The name and title of the individual who verified the account The date and system used for verification The chain of custody of the alleged account data Simply stating that the furnisher verified the account is insufficient. Verification of data is not verification of ownership. Demand for Contractual Proof If Nationwide or Aargon contend that the accounts are legitimate, they must produce competent proof of authorization, including : A signed contract bearing my wet signature ; or A verifiable electronic signature showing affirmative consent ; and Authentication logs tied to account opening ; and Application records initiated by me To date, no signed agreement or authenticated proof has been produced. Address association does not equal consent. Residency does not equal contract. Data presence does not equal authorization. Without contractual documentation, continued reporting is improper. Improper Reliance on Furnisher Statements Merely contacting the furnisher and accepting their statement that the account is valid does not constitute a reasonable reinvestigation in an identity theft case. When fraud is alleged and supported by an FTC affidavit, a reporting agency must do more than forward the dispute and accept the response at face value. The issue is ownership. If the furnisher can not prove I entered into a contractual relationship, the account must be deleted. Continued Reporting Causes Harm The continued presence of these fraudulent accounts has caused substantial harm, including : Credit score damage Increased interest rates Reduced credit access Emotional distress Time and expense disputing inaccurate reporting I should not suffer financial consequences for fraud committed by someone else. Failure to Block Fraudulent Information When a consumer submits an identity theft report, fraudulent accounts must be blocked from reporting unless the furnisher establishes that the information is correct and belongs to the consumer. No such proof has been provided. Therefore, continued reporting is improper. Formal Requests I am formally requesting : Immediate deletion and blocking of the XXXX XXXX XXXX tradeline. Immediate deletion and blocking of the XXXX XXXX tradeline. Written confirmation of deletion. Written confirmation that these accounts will not be reinserted. Full disclosure of the method of verification used. Copies of any signed agreements relied upon to maintain reporting. If signed contracts or authenticated proof can not be produced, deletion is required. This Is a Stall and Escalation Notice This letter serves as notice that the matter remains open and under active dispute. Any continued reporting without production of signed contractual proof will be considered reporting without proper validation. I am creating this new case because the prior closure did not correct the inaccuracy. The accounts remain fraudulent. The reporting remains harmful. The matter remains unresolved. Final Position I did not open these accounts. I did not authorize these accounts. Experian has already recognized them as fraud. I filed an FTC Identity Theft Report. If the furnishers can not produce competent proof of authorization, the accounts must be permanently deleted. Until that occurs, this dispute remains active.
