Consumer Narrative

On a prior dispute, these student loan accounts were removed from my credit report after being identified as identity theft. Subsequently, the accounts were reinserted onto my report with different start dates and different loan amounts. I was not provided advance written notice of reinsertion as required under 15 U.S.C. 1681i ( a ) ( 5 ) ( B ) ( ii ). Additionally, because these accounts were previously disputed as identity theft, reinsertion without proper certification of accuracy and compliance with 15 U.S.C. 1681c-2 raises concerns regarding unlawful re-reporting of identity theft information. The reinserted tradelines contain materially different account details, including modified dates and balances, which suggests inaccurate or inconsistent reporting. I request documentation showing : Certification of accuracy used to justify reinsertion Written notice of reinsertion sent to me Documentation linking me to the account Method of verification used prior to reinsertion If the furnisher and credit reporting agency can not demonstrate full compliance with FCRA reinsertion requirements, the accounts must be permanently deleted. Now for What would be a fair resolution? paste this : A fair resolution would be permanent deletion of the reinserted student loan accounts unless the company can provide documented certification of accuracy and proof of compliance with 15 U.S.C. 1681i ( a ) ( 5 ) ( B ) and 1681c-2. In addition to the student loan reinsertion issue, I am disputing inaccurate reporting related to a vehicle repossession account. The tradeline reflects repossession and/or collection-related derogatory coding ; however, I requested documentation substantiating the reporting, including the Date of First Delinquency, date of repossession, date of sale, itemized deficiency balance calculation, and documentation supporting any collection placement. No such documentation has been provided. Under 15 U.S.C. 1681s-2 ( b ), a furnisher must conduct a reasonable investigation after receiving notice of dispute and must correct or delete information that can not be verified. Under 15 U.S.C. 1681e ( b ), reporting must reflect maximum possible accuracy and must not be materially misleading. If the account is being reported simultaneously as a repossession, charge-off, and/or collection without clear and accurate status coding and supporting documentation, such reporting may create a materially misleading credit impression. Because the furnisher has failed to provide documentary substantiation and continues furnishing derogatory information with disputed status coding, I request correction or deletion consistent with FCRA requirements. Now for Fair resolution you can strengthen it like this : A fair resolution would be permanent deletion of the reinserted student loan accounts and correction or deletion of the repossession tradeline unless the company can provide documented certification of accuracy and proof of compliance with 15 U.S.C. 1681i ( a ) ( 5 ) ( B ), 1681c-2, 1681e ( b ), and 1681s-2 ( b ).
