Dear Consumer Financial Protection Bureau, I am submitting this formal complaint against Discover Credit Card regarding ongoing wrongful and improper billing practices on my credit card account, which was paid in full and closed in XX/XX/year>. There was no activity on this account for months beginning in XX/XX/year>. No purchases, cash advances, or transactions were made. In XX/XX/year>, I made a payment that brought the account balance to XXXX. At that time, there was no remaining balance due. I was not properly notified in writing via U.S. Mail that the account had been closed by Discover, nor was I advised of any outstanding obligation. Despite there being no activity on this account for months since XX/XX/year> and despite the account being paid to a XXXX balance in XX/XX/year>, this financial institution has continued to wrongfully assess late fees, interest charges, collection fees, and additional fees. These charges were applied without proper written notice and without justification. As a direct result of these improper actions, the account now reflects a balance exceeding XXXX XXXX dollars, comprised entirely of fees that should not have been charged. Under federal law, including the Credit Card Accountability Responsibility and Disclosure ( CARD ) Act, credit card issuers are prohibited from charging monthly maintenance or inactivity fees on closed accounts and can not declare an account in default simply because it has been closed. The continued assessment of fees under these circumstances raises serious concerns about compliance with federal consumer protection laws. This account must be immediately cleared of all late fees, interest charges, and any and all additional fees assessed from XX/XX/year> through the present, prior to any demand for payment. The balance should be corrected to reflect XXXX, and written confirmation of these corrections must be provided. Any negative credit reporting resulting from these improper charges must also be removed. If this matter is not resolved promptly, I will escalate this issue and file an additional complaint with the Federal Reserve System requesting a formal investigation into unfair practices, discrimination, and violations of federal law. I respectfully request a thorough investigation and immediate corrective action.
