Consumer Narrative
FORMAL NOTICE OF DISPUTE DEMAND FOR VALIDATION, PROOF OF OWNERSHIP, AND PROOF OF STANDING To Whom It May Concern : This letter serves as a formal dispute of the above-referenced account. I recently discovered that Jefferson Capital Systems , LLC is reporting this alleged debt on my consumer credit reports. I have never received the required written notice within five ( 5 ) days of your initial communication, as required under 15 U.S.C. 1692g ( a ) of the Fair Debt Collection Practices Act ( FDCPA ). Your failure to provide the mandatory notice is a violation of federal law. This alleged debt is hereby disputed in its entirety. DEMAND FOR VALIDATION ( 15 U.S.C. 1692g ) Pursuant to the FDCPA and applicable case law, you are required to cease collection activity and reporting until you provide proper validation. In order to validate this debt, you must provide : The name and address of the original creditor The amount of the alleged debt, with a full accounting The date of default The date of charge-off A complete payment history The contract bearing my signature DEMAND FOR PROOF OF OWNERSHIP AND STANDING Because Jefferson Capital is not the original creditor, you must also prove you have lawful ownership and standing to collect and report this alleged debt. You are required to produce : The Purchase and Sale Agreement The Forward Flow Agreement The Bill of Sale The specific Account-Level Assignment showing my account number The complete Chain of Title from the original creditor to Jefferson Capital Any assignment contract evidencing transfer of rights Courts have consistently held that a debt buyer must prove standing and ownership through competent evidence. In XXXX v. Portfolio Recovery Associates, the Court held that a debt buyer must demonstrate actual ownership and assignment of the specific account in order to establish standing. Generalized bills of sale without account-level identification are insufficient. NOTICE REGARDING CREDIT REPORTING If you continue to report this account without proper validation and proof of ownership, you may be in violation of : 15 U.S.C. 1692e ( false representation ) 15 U.S.C. 1692f ( unfair practices ) 15 U.S.C. 1692g ( b ) ( continuing collection without validation ) 15 U.S.C. 1681s-2 ( b ) ( failure to conduct reasonable investigation ) Continued reporting without proof of ownership may constitute furnishing information you can not substantiate. DEMAND FOR DELETION If you can not provide the above documentation within 30 days, you must : Immediately cease collection activity Delete all credit reporting related to this account Provide written confirmation of deletion NOTICE OF INTENT TO ESCALATE If Jefferson Capital fails to comply, I reserve all rights to : Initiate arbitration pursuant to any governing agreement File suit in Federal Court Seek statutory damages under the FDCPA Seek actual damages and attorneys fees Seek damages under the FCRA This letter is not a refusal to pay, but a notice that your claim is disputed and must be validated. Govern yourselves accordingly.
