Prior CFPB Complaint Numbers : XXXX and XXXX This complaint is a follow-up to the prior CFPB complaints referenced above. United Wholesale Mortgage ( UWM ) has not resolved documented mortgage servicing errors and has provided a response that is incomplete and inconsistent with its own records and communications. UWM acknowledged receipt or identification of a second {$500.00} payment and later contradicted that acknowledgment without providing a reconciliation or investigation explaining the discrepancy. Throughout XXXX, I made good-faith payments and repeatedly contacted UWM requesting a complete and accurate payment ledger, a corrected balance, and written instructions on how to bring my loan current. During this period, UWM misapplied payments across multiple months, applied later payments backward without clear disclosure, and failed to provide a clear reinstatement amount or path to cure. At various times, UWM representatives instructed me not to submit payment while payment application issues and a servicing transfer were under review. I relied on those instructions while remaining ready and able to pay. Despite unresolved servicing errors and active efforts to resolve the account, UWM furnished adverse credit reporting and reported serious delinquency. Reporting severe delinquency while payments were being accepted and disputes remained unresolved is inaccurate and misleading under the Fair Credit Reporting Act ( 15 U.S.C. 1681s-2 ) and Regulation V. The payment application issues occurred during a servicing transfer, and under 12 C.F.R. 1024.33 ( c ) I should not have been penalized or escalated for transfer-related payment issues while those errors remained unresolved. On XX/XX/year>, UWM referred my loan to foreclosure without first resolving payment disputes, without providing a clear reinstatement amount, and without extending appropriate loss mitigation protections. UWMs own response shows that loss mitigation review did not resume until XX/XX/XXXX, XXXX foreclosure activity had already beguncontrary to RESPA Regulation X ( 12 C.F.R. 1024.41 ). UWM also restricted my access to the online servicing portal during this period, impairing my ability to monitor my account and dispute errors. At all times, I was willing and able to pay the amount legitimately owed. The delinquency, credit damage, and foreclosure referral resulted from UWMs servicing failures, lack of clear instruction, and payment application decisionsnot borrower refusal or inability to pay. I remain ready and able to satisfy all legitimate obligations owed and have consistently requested only an accurate accounting and correction of servicer-caused credit reporting errors.
