Subject : Debt Collector Failure to Validate Debt & Improper Credit Reporting Company Name : WESTLAKE FINANCIAL SERVICES LLC Account Number XXXX Complaint : I am filing a complaint regarding violations of the Fair Debt Collection Practices Act ( FDCPA ) and the Fair Credit Reporting Act ( FCRA ) committed by the above-named debt collector/furnisher. First attemp was on XX/XX/XXXX, I sent a written debt validation request pursuant to 15 U.S.C. 1692g ( b ). The collector received my request on XX/XX/XXXX but has not provided any validation. Despite failing to validate the debt, they have continued collection activity including : Calling/sending letters after receiving my dispute Reporting the debt to the credit bureaus Failing to mark the debt as disputed ( FCRA requirement ) These actions violate : FDCPA Violations 15 USC 1692g ( b ) continued collection without validation 15 USC 1692e false/misleading representations 15 USC 1692f unfair practices FCRA Violations 15 USC 1681s-2 ( a ) ( 3 ) failure to report debt as disputed 15 USC 1681s-2 ( b ) failure to conduct a proper investigation after a bureau dispute Reporting inaccurate or unverified information I am requesting that the CFPB require the company to : 1. Provide full validation of the debt 2. Cease collection until validation is provided 3. Correct or delete any unverified credit reporting 4. Mark the account as disputed 5. Provide a written response explaining their actions. I have been ignored and they have been negligent since my inital request. Supporting documents provided : Copy of my validation requestI conditionally accept your claim that I owe this DEBT upon VERIFIED PROOF of Contract bearing my wet ink signature as well as full disclosure. Absent of that proof your presumption is null and void. Please note that this is not a refusal to pay off the account but a notice sent as per the Fair Debt Collection Practices Act ( F.D.C.P.A. ), 15 U.S.C. 1692 ( G ) Section 809 ( B ). This notice states that your claim is disputed and validation of the account is required. This notice is not a request for verification of the account or proof of my mailing address but a request for validation made pursuant to the F.D.C.P.A. laws. I humbly request that your agency/ office sends me valid proof of claim that I am legally obligated to pay you. Please provide me with the below mentioned items : * Proof of chain of title * The amount you claim the Respondent owes you * If there was a 1099-a or 1099-c I would like my COPY B for my tax purposes * An explanation showing me how you have computed the amount. * Copies of any documents that prove I agreed to pay the alleged amount * The identity of the original creditor * Confirmation that the account has not crossed the statute of limitation ( SOL ) period * Evidence that you are a licensed debt collector * Evidence of your license numbers and your registered agent. * Show me that the vehicle has not been sold. I have asked for full accounting yet i only received a copy of the account payment history. Please NOTE that it is a REQUIREMENT by the IRS to FURNISH COPY B to the BORROWER per IRC 6041 & section 6050J/6050P. Failure to do so does have penalties under CODE 6722 This is showing that WESTLAKE has closed the account on my credit ( XX/XX/XXXX ), but continue to open it back up each month. As well the amount that was made from the car selling was added back to the principal balance that is claimed I OWE. Down payments and Installments in CONSUMER CREDIT TRANSACTIONS. CASH or CREDIT not both which is misleading advertising UCC CODES : 15 USC 1692G : Ignored- Moving in dishonor must provide disclosure of the debt ( which form was filed ) 15 USC 1611 : Criminal offense by not providing my requested documents If they cant give me the documents in writing 15 USC 1692K which states CIVIL PENALTY UCC 1-201 : Failure of consideration/fraud seller made false statements or withheld material value 15 USC 1662 : No valid contract formed due to lack of full disclosure UCC 3-603 : Tender refused is without valid reason, if refused there is discharge. Credit report showing continued reporting- My credit report shows that it gets reported then taking off every month. Thank you for your assistance.
