I am submitting this complaint regarding PHH Mortgage Services, the mortgage servicer for my loan on behalf of XXXX XXXX XXXX XXXX XXXX. On XX/XX/XXXX, I sent PHH Mortgage Services a formal Qualified Written Request ( QWR ), Request for Information, and Notice of Error pursuant to the Real Estate Settlement Procedures Act ( RESPA ), 12 U.S.C. 2605 ( e ), and Regulation X ( 12 C.F.R. 1024.35 and 1024.36 ). This complaint concerns ongoing mortgage servicing failures, foreclosure-related misconduct, and improper disclosure of my non-public personal information. Improper Third-Party Disclosure / Process Server Misconduct On XX/XX/XXXX, a process server acting in connection with a foreclosure matter appeared at an apartment residence that is not my home address. That address belongs to an individual for whom I previously co-signed a lease. I do not reside at, receive mail at, or have any legal interest in that residence. During this visit, the process server disclosed confidential and sensitive information to third parties who have no legal interest in my mortgage loan. Specifically, the process server showed legal paperwork and informed the occupants that they were attempting to locate me because my home was in foreclosure. This disclosure was made to unauthorized third parties and constitutes a serious breach of privacy, failure to safeguard borrower information, and a violation of reasonable mortgage servicing standards. PHH Mortgage Services is responsible for the conduct of its retained agents and vendors, including process servers and foreclosure counsel. Failure to Provide Required Foreclosure and Servicing Information PHH Mortgage Services has failed to clearly and transparently provide critical foreclosure-related information, including : The identity and contact information of the law firm representing the plaintiff in the foreclosure ; The name ( s ) of the attorney ( s ) of record authorized to act on behalf of the plaintiff ; The exact date the foreclosure action was filed, including the court, jurisdiction, and case number ; A complete mortgage servicing file and life-of-loan payment history ; Records of third-party vendors, including process servers ; Documentation establishing foreclosure authority. These failures impair my ability to understand, verify, and protect my rights in connection with foreclosure proceedings and constitute servicing errors under RESPA and Regulation X. Harm Caused PHH Mortgage Services actions and omissions have caused : Unauthorized disclosure of my private financial and legal information ; Reputational harm and emotional distress ; Interference with my ability to respond appropriately to foreclosure proceedings ; Ongoing uncertainty regarding the accuracy and legality of foreclosure enforcement actions. What I want the company to do I am requesting that PHH Mortgage Services be required to : Fully respond to my Qualified Written Request, Request for Information, and Notice of Error within the timeframes required by RESPA and Regulation X ; Provide the name, address, and contact information of foreclosure counsel and attorneys of record ; Provide the complete mortgage servicing file and life-of-loan history ; Identify the process server and the entity that retained them ; Explain how my confidential information was disclosed to unauthorized third parties ; Confirm corrective actions taken to prevent future privacy violations ; Review and confirm that all foreclosure activity complies with applicable federal and state law.
