Consumer Narrative

I am filing this complaint to formally dispute the repossession and credit reporting associated with my XXXX XXXX XXXX XXXX, XXXX XXXX, financed through Global Lending Services ( account ending XXXX ). I was the primary borrower on this account and remained current on payments through XX/XX/XXXX, paying approximately {$1000.00} per month since purchasing the vehicle on XX/XX/XXXX. I did not voluntarily surrender, abandon, or authorize the repossession of this vehicle. In XX/XX/XXXX, the vehicle was taken from my possession by the co-signers mother, an individual with no ownership interest, no contractual authority, and no legal right to the vehicle. This constituted unauthorized possession and interference with my property. I was coerced and prevented from safely reclaiming the vehicle. Global Lending Services was never notified by me of any voluntary surrender. The vehicle remained in unauthorized XXXX-party control for several months and was ultimately repossessed in XX/XX/XXXX, without my knowledge or participation. The default and repossession were directly caused by XXXX-party interferencenot by financial neglect or willful nonpayment on my part. Following repossession, the vehicleoriginally financed at approximately XXXX XXXXwas sold for substantially below fair market value, resulting in an alleged deficiency balance of approximately {$17000.00}. This raises serious concerns regarding commercial reasonableness under UCC 9-610 ( b ), which requires that the disposition of collateral be reasonable in method, manner, time, and price. Despite these facts, Global Lending Services continues to report the repossession and deficiency balance to consumer reporting agencies. This reporting is materially inaccurate and misleading, in violation of the Fair Credit Reporting Act ( 15 U.S.C. 1681 et seq. ), including but not limited to : 1681s-2 ( a ) ( 1 ) ( A ) Furnishing inaccurate information 1681s-2 ( b ) Failure to conduct a reasonable investigation after dispute 1681e ( b ) Failure to ensure maximum possible accuracy 1681n / 1681o Liability for willful or negligent noncompliance This inaccurate reporting has caused substantial harm by preventing me from obtaining transportation, loans, and housing.
