Company : Capital One Auto Finance Product : Auto Loan I am submitting this complaint regarding improper handling of my auto loan following a voluntary surrender on XX/XX/XXXX. I financed a vehicle through Capital One Auto Finance and purchased a GAP insurance policy at the time of contract signing on XX/XX/XXXX, through a XXXX dealership. The GAP policy was administered by XXXX and was included in the retail installment contract. Following the voluntary surrender of my vehicle, Capital One Auto Finance failed to follow legally required post-repossession procedures, including : Failure to provide a post-sale accounting or deficiency explanation Failure to disclose the auction sale price, date of sale, or calculation of the remaining balance Cancellation of the GAP insurance policy without applying GAP proceeds or refunds to the loan balance To date, I have never received written notice detailing the auction sale, fees deducted, net proceeds applied, or an explanation of how the remaining balance was calculated. These failures violate California Civil Code 2983.2 and UCC 9-616 and undermine Capital Ones right to collect any alleged deficiency balance. I have sent written demand letters to Capital One Auto Finance, the dealership ( XXXX ), and the GAP administrator ( XXXX ), requesting documentation and correction of my account. These issues remain unresolved. I am requesting the following resolution : 1. Full post-sale accounting and auction sale details 2. Application of all GAP proceeds or refunds to my loan balance 3. Correction or elimination of the remaining balance 4. Correction of any inaccurate credit reporting related to this account This complaint is submitted in good faith to resolve these violations
