Consumer Narrative
Before closing this complaint without review, note that continued reporting of these accounts violates the FCRA ; either correct or delete them immediately, as I have already filed complaints with the FTC and the Attorney General and will pursue legal action if noncompliance continues. The accounts involved, also take note, I'm not the only victim XXXX XXXX other student loan borrowers were impacted by illegal tactics XXXX XXXX Account # XXXX XXXX XXXX Account # XXXX XXXX XXXX Account # XXXX I am filing this complaint against the XXXX Department of Education regarding XXXX XXXX XXXX XXXX XXXX that are being inaccurately and inconsistently reported across the credit bureaus. All three accounts are reported as Transferred / Account closed due to transfer, with a {$0.00} balance and {$0.00} past due, yet they are simultaneously being reported with severe delinquency statuses ( Late 120 days / Late 180 days ). Reporting a closed, transferred, zero-balance account as actively delinquent is factually inconsistent and misleading. Additionally, these XXXX accounts show conflicting payment statuses across XXXX, XXXX, and XXXX, including : Different delinquency severities for the same time periods Inconsistent last reported dates ( ranging from XX/XX/year> to XX/XX/year> to XX/XX/year> ) Payment histories reflecting ongoing late activity despite the accounts being closed and transferred These discrepancies indicate that the Department of Education and/or its servicer is not maintaining reasonable procedures to ensure maximum possible accuracy, as required under the Fair Credit Reporting Act ( 15 U.S.C. 1681e ( b ) ). I formally disputed these inaccuracies more than XXXX days ago, yet the incorrect reporting remains unchanged, constituting a failure to conduct a lawful reinvestigation under FCRA XXXX ( a ). Specific Reporting Discrepancies ( Account-Level ) All three XXXX XXXX accounts show the following conflicts : XXXX Balance vs. Active Delinquency Balance : {$0.00} Past Due : {$0.00} Status : Account closed / transferred Yet reported as Late 120180 days, which is not logically or legally accurate for a closed, zero-balance account. Inconsistent Payment Status Across Bureaus XXXX reports Late 180 days XXXX reports Late 120 days XXXX reports Late 120 days These differences show that the data furnisher can not substantiate a single, accurate payment history. Conflicting Last Reported and Last Active Dates The accounts show activity after transfer and closure, which is improper under XXXX XXXX guidelines once an account has been transferred to another servicer. Improper Continued Reporting After Transfer Once transferred, the original furnisher must either : Report accurately with a {$0.00} balance and neutral status, or Cease reporting altogether Continued derogatory reporting after transfer violates XXXX XXXX and FCRA accuracy standards. The Department of Education and its servicers have been widely challenged and sued for : Misreporting loan statuses Inaccurate balances Improper delinquency reporting during transfers, deferments, or servicing changes Given this well-documented history, the inaccuracies on my credit report raise serious concerns about systemic reporting failures rather than isolated clerical errors. Laws & Standards Violated FCRA XXXX ( b ) Failure to maintain reasonable procedures for maximum possible accuracy FCRA XXXX ( b ) Failure to properly investigate disputed information FCRA XXXX ( a ) Failure to complete a lawful reinvestigation within 30 days XXXX XXXX Reporting Guidelines Improper reporting of transferred/closed student loan accounts as delinquent
