XXXX XXXX XXXX, XXXX XXXXXXXX Subject : Complaint Unlawful Third-Party Disclosure by Debt Collector To Whom It May Concern : I am writing to file a complaint regarding unlawful debt-collection practices by a debt-collection agency, which contacted my parent about a debt belonging to me alone. The contact is not only inappropriate but also a violation of federal law and my consumer rights under the Fair Debt Collection Practices Act ( FDCPA ) and applicable California law. Details : - My name : XXXX XXXX - My account / card or creditor : [ XXXX XXXX XXXX XXXX XXXX XXXX ] - Date ( s ) of third-party contact : XXXX XXXX XXXX XXXX Nature of contact : The collector identified the debt, named the creditor, provided a link and phone number to collect the debt, and stated that this was an attempt to collect a debt. The collector directed this message to my parent, who is in no way associated with the account or the debt. - Why this is improper : Under FDCPA and California law, collectors may contact a third party only to obtain location information, not to disclose debt details or attempt collection. This contact goes well beyond location information. I request that the CFPB investigate this matter as a violation of the law. I believe I may be entitled to statutory damages under the applicable consumer-protection laws. Please let me know what further information or documentation you need from me. I have attached copies of the text message sent to my parent and any relevant account/collection-agency information. Thank you for your attention to this matter. Sincerely, XXXX XXXX XXXX : On XXXX XXXX XXXX they contacted me personally via text, then also contacted my parent who is not on the credit card, did not co-sign and is not associated in any way to collect the debt. I am also not a minor. They disclosed the debt, that I owe debt, and along with that mentioned they were a debit collector and a link to pay off the debt through their portal. They sent the same message they sent me to my dad. This is extremely embarrassing, and not correct to do. I had to play it off as spam since my dad didn't even know this was an issue.
