I am submitting this complaint to dispute the inaccurate and unlawful reporting of one or more collection accounts appearing on my consumer credit reports with XXXX, XXXX, and XXXX. The collection account ( s ) are being reported with incomplete, inconsistent, and unverifiable information, in violation of the Fair Credit Reporting Act ( 15 U.S.C. 1681 et seq. ). Under 15 U.S.C. 1681s-2 ( a ) ( 1 ), a furnisher may not report information it knows or has reasonable cause to believe is inaccurate. Additionally, pursuant to 15 U.S.C. 1681s-2 ( b ), upon receipt of a dispute, the furnisher is required to conduct a reasonable investigation and delete or correct information that can not be verified. Further, this conduct violates the Fair Debt Collection Practices Act, including but not limited to 15 U.S.C. 1692e and 1692f, which prohibit false, misleading, deceptive, unfair, or unconscionable collection practices. Reporting inaccurate or unverified collection data to consumer reporting agencies constitutes a misrepresentation of the character, amount, or legal status of the alleged debt. Because I am a Texas consumer, these actions also violate the Texas Debt Collection Act ( Texas Finance Code 392 ), including : 392.303 ( a ) ( 2 ) : Prohibits collecting or attempting to collect charges not authorized by the agreement or law 392.304 ( a ) ( 8 ) & ( 19 ) : Prohibits misrepresenting the character, extent, amount, or status of a debt, and using deceptive means to collect or obtain information 392.202 : Requires accurate investigation and correction of disputed items Additionally, the collection account ( s ) fail to comply with XXXX XXXX reporting standards, including inaccurate reporting of the date of first delinquency, account status, balance, and ownership of the alleged debt. Because the information can not be fully verified as accurate and compliant with federal and Texas law, continued reporting is unlawful and harmful. I respectfully request that the CFPB investigate this matter and require the immediate deletion of the disputed collection account ( s ) from all consumer reporting agencies. Please provide written confirmation of the outcome and actions taken.
