Dakota Financial has repeatedly failed to correctly apply my payments, has misapplied a check payment despite receiving full proof of payment, and issued an acceleration/collection letter during an active billing-error dispute. I have provided Dakota with the front and back of my cleared checks, my bank posting confirmations, a written timeline, and multiple emails showing that their internal payment system malfunctioned and prevented me from making a timely payment. The payment delay was entirely due to Dakotas system issues, not mine. I have an email from Dakota acknowledging they had knowledge of the issue. I sent a formal billing-error dispute letter via certified mail containing full documentation and a check for the XXXX payment. Dakota cashed the check, proving they received both the dispute and the payment. Despite this, they failed to correct the account and continued to send invoices showing the payments misapplied. On XX/XX/year>, I received an acceleration/collection letter demanding the full balance and threatening repossession. This was sent while my account was in a formal dispute and after Dakota had misapplied my payments. This violates federal servicing standards, the Fair Credit Reporting Acts accuracy requirements, UCC good-faith rules, and basic dispute-handling obligations. Correctly apply my payment ( s ) 2. Reverse the improper acceleration 3. Remove all late fees caused by their system issues 4. Confirm in writing that no negative credit reporting has been made 5. Cease collection activities during the dispute 6. Respond to my dispute in writing as required
