Consumer Narrative

I am filing this complaint with the Consumer Financial Protection Bureau ( CFPB ) regarding the fraudulent and unjust civil case and judgment filed against me by MANDARICH LAW GROUP , LLP on behalf of XXXX XXXX XXXX, in the amount of {$1700.00} and/or any other amount. I am not the debtor and have never opened, authorized, or benefited from the alleged account. This debt is entirely the result of identity theft, and the subsequent legal action filed against me is based on fraudulent information. Being sued and having a judgment entered against me for a debt I did not incur has caused severe emotional distress, financial harm, and constant XXXX, as I am left to deal with the repercussions of identity theft while facing unlawful collection efforts. Pursuing a debt tied to identity theft violates several consumer protection laws, including the Fair Credit Reporting Act, which mandates that only accurate information be reported, and the Fair Debt Collection Practices Act, which prohibits the collection of debts that are not owed. In addition, this conduct also violates California Civil Code section 1798.92 et seq., which protects victims of identity theft from liability for unauthorized debts, and the Rosenthal Fair Debt Collection Practices Act ( California Civil Code section 1788 et seq. ), which ensures that debt collectors do not harass consumers for debts they do not owe. I am now taking formal legal steps to address this issue, including filing a police report to document the identity theft and seeking to vacate the limited civil case and judgment. I am requesting that the CFPB assist me in vacating this civil case, as it was filed in violation of my rights, causing ongoing harm that I should not be responsible for, and ensuring that this fraudulent activity does not affect my credit or legal standing.
