This complaint is being filed in addition to my active CFPB complaint # XXXX. I am submitting a second complaint because Professional Credit Service ( PCS ) contacted me on XX/XX/year> to collect a debt while a federal complaint was already open AND after receiving my updated dispute/validation request earlier that same morning. PCS had full notice that the debt was disputed, under federal review, and that I had requested any signed agreement or proof of responsibility, yet they continued collection activity without providing validation. This complaint addresses that new violation window. On XX/XX/year>, I mailed PCS an updated written dispute and validation request. XXXX tracking confirms they received it on XX/XX/year> at XXXX a.m. Despite receiving this new dispute that same morning, PCS called me at XXXX XXXX and attempted to collect for over XXXX minutes. During the call, I informed PCS about the active CFPB complaint and the updated dispute. I again requested any documentation bearing my signature, including any intake form or financial responsibility agreement. PCS could not provide anything and continued trying to collect anyway. PCS has never produced validation of any kind : no signed agreement, no intake form with my signature, no financial responsibility contract, and no documentation tying me to the debt. All paperwork from the medical provider shows another individuals signature, not mine. PCS has acknowledged multiple times that they had to request documents from the client, yet months have passed without a single piece of proof showing I agreed to this debt. I have submitted multiple written disputes, a compliance review request outlining XXXX validation questions PCS can not answer, and supporting evidence including delivery confirmations, copies of my disputes, and the intake forms showing another persons signature. PCS continues attempting to collect and pursued litigation without ever validating the debt or confirming I was the responsible party. This second complaint is necessary because the XX/XX/XXXX collection attempt occurred AFTER PCS had full knowledge of the dispute, the federal complaint, the lack of documentation, and the legal requirement to cease collection during validation. PCS is attempting to collect a debt that is not mine and can not produce a single document with my signature to support their claim. Based on my understanding, PCSs conduct appears to violate multiple consumer-protection standards, including : FDCPA 15 U.S.C. 1692g ( b ) continuing collection without validating the debt after a written dispute FDCPA 15 U.S.C. 1692e ( 2 ) ( A ) misrepresenting the character or legal status of a debt FDCPA 15 U.S.C. 1692e ( 10 ) using deceptive means to collect a debt ( pursuing the wrong party ) FDCPA 15 U.S.C. 1692f unfair or unconscionable means ( attempting collection with no signed agreement ) Oregon Unlawful Debt Collection Practices Act ( ORS 646.639 ) attempting to collect a debt from someone who is not legally obligated ORS 646.639 ( 2 ) ( k ) attempting to enforce a right or remedy that does not exist PCS continues to pursue collection and litigation against the wrong party with no signed documentation to support their claim.
