I am disputing a rental housing debt reported by Source Receivables on behalf of XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ). This debt is not legally mine because XXXX violated multiple provisions of Texas XXXX XXXX XXXX XXXX, which voids the alleged balance entirely. My lease ended on XX/XX/XXXX, and I returned all keys and vacated the unit. Under Texas Property Code 92.104 ( a ), a landlord must provide the tenant with a final itemized list of deductions and disposition of the security deposit within 30 days after move-out. XXXX did not provide any itemized charges within that required 30-day period. Instead, the first billing email demanding {$830.00} was sent on XX/XX/XXXXXXXX XXXX days after move-out and well beyond the statutory deadline. Under FDCPA 809 ( a ) ( 15 U.S.C. 1692g ( a ) ), a debt collector must send a written validation notice within five days of the first collection attempt. Source Receivables never provided any initial communication, never gave me an opportunity to dispute the debt, and never validated any information before furnishing it. This is a direct violation of FDCPA 809 ( a ) and 809 ( b ), as well as FDCPA 807 for false representation of the amount and legal status of a debt. Critically, the XXXX credit report states that the collection account was opened on XX/XX/XXXX and reported as past due in XXXX XXXX I was never contacted at any time before or after that date. I request that the CFPB require XXXX and Source Receivables to : ( 1 ) acknowledge the debt as invalid under Texas law, ( 2 ) cease all collection activity immediately, and ( 3 ) remove this account from all credit bureaus due to violations of Texas Property Code, the FDCPA, and the FCRA.
