Consumer Narrative
Spring Oaks Capital has claimed a debt and has reported to CRA 's as a furnisher- without compliance to law. Spring Oaks Capital response is a standard form letter only. It fails to accept accountability for failure to comply entirely with Section XXXX of the FCRA, XXXX U.S.C. XXXX. Specifically Sections XXXX ( a ) ( XXXX ) ( A ) and ( a ) ( XXXX ) ( C ) .. Furnisher must notify all XXXX that received the information of any corrections, and must thereafter report only the complete and accurate information. Section XXXX ( a ) ( XXXX ). XXXX evidence has been provided in writing, authorizing the collection of this alleged debt. Furnisher is required by law to notify in writing, and supply evidence of authorization of contract to collect this debt. Furnisher is required by law to comply. Furnisher ( debt collector entity ) must be able to prove the debt * and * their legal right to collect it. A written " debt-validation request '' has not been provided as per the FDCPA. Furnisher has not supplied the required evidence including : XXXX. Debt Validation Notice ( mandatory ) Within XXXX days of first contact, they must send a written notice that includes : * Amount of the debt * Name of the original creditor * Statement of your right to dispute the debt within XXXX days This furnisher has not done this - therefore this is a compliance fail. XXXX. Proof the debt exists A letter of dispute for the debt was provided to furnisher, multiple times. Each time, the furnisher has failed to supply the lawfully required validation in writing within XXXX days, therefore all collection must cease. They must provide validation including but not limited to : * A copy of a bill, statement, or contract showing the debt * Your name and identifying info tied to the debt * The amount owed and how it was calculated Because the furnisher has NOT complied with this legal requirement, the debt remains invalid. XXXX. Proof theyre authorized to collect Furnisher MUST show " legal standing '' via : * " Assignment or purchase agreement '' - showing the debt was transferred to them * A " collection contract '' - authorizing them to collect on behalf of the original creditor I am entitled to see all documentation connecting the alleged specific debt, to the " specific agency *. The agency has repeatedly and purposely failed to comply with this legal requirement since first reported. And generic spreadsheets or we own a portfolio summary, or a standard form letter- is insufficient. XXXX. Chain of title ( if the debt was sold multiple times ) This alleged debt has changed hands multiple times, therefore the law requires the furnisher to show : * The " chain of assignment '' from the original creditor current collector Because the furnisher flatly refuses to show the chain of assignment from original creditor to current furnisher - there is no legal claim. XXXX. State-level required information for Utah including XXXX * Collectors * * license number * * * Registration with the state * Additional disclosures or sworn statements Therefore, this furnisher is non-compliant with both federal and state laws, and must retract all efforts to collect a non-provable debt. The law specifies the furnisher MAY NOT : * Keep collecting while validation is pending * Refuse to provide proof but still demand payment * Threaten lawsuits without legal standing * Report the debt to XXXX XXXX without verification Therefore, I am permitted to invoice this agency {$1000.00} / month since this illicit collection activity began because of non-compliant illicit reporting. If this furnisher can not show all of the above requirements by law - specifically proving : XXXX the debt is real XXXX the amount is accurate XXXX they are legally authorized to collect it They must remove and cease ALL debt collection activity, and pay the fines of {$1000.00}/ month of falsely reporting illicit debt collection. In this case every month of negative reporting since first report to XXXX XXXX.
