I am submitting this response as part of a new CFPB case, as the prior case # XXXX was closed, and Kikoff Lending , LLC has XXXX to report inaccurate information without providing legally sufficient proof of account ownership. I formally dispute Kikoffs response and request further CFPB review. Kikoff claims its investigation confirmed account ownership based solely on information provided at signup, including name, date of birth, Social Security number, and email address. This is not valid proof of authorization or ownership. Self-reported identifying information is routinely used in identity theft and does not establish contractual liability. I have filed an FTC Identity Theft Report and identity theft affidavit because I do not own this account. Under FCRA XXXX, once an identity theft report is submitted, a furnisher must block fraudulent information unless it can demonstrate that the account was legitimately opened by the consumer. Kikoff has failed to meet this burden.
