During 2023, my spouse and I contacted our mortgage servicer, M & T Bank, to request assistance through a loan modification for our FHA mortgage. While the loan modification was under review, we were informed that mortgage payments were not required during the modification review period. Based on this guidance, we acted in good faith and did not submit payments while the modification review was pending. Despite this, the servicer later reported multiple late payments to the credit bureaus for the same months that the loan modification was under active review. The late payments reported appear as a single consecutive group during 2023. These late payments were not the result of neglect or unwillingness to pay, but rather occurred because we relied on the servicers instructions during the modification process. Once the loan modification review concluded and we were informed that payments were required, we resumed making payments immediately. The account has remained current since that time and is presently in good standing. We later contacted the servicer to request correction or removal of the late payment reporting, explaining that the non-payments occurred based on the servicers guidance during the loan modification review. That request was denied without resolving the underlying issue. The continued reporting of these late payments does not accurately reflect our payment obligation during the loan modification review period and is causing significant and ongoing harm to our credit profile.
